This website is operated by By Sophie Photography, a trading name of Sophie Louise Matthews, a sole trader.

2. These terms

These terms apply when you purchase digital image files, photographic prints or other photography products through this website.

Please read them before placing an order. By completing your purchase, you agree to these terms.

We may update these terms occasionally. The terms that apply to your order will be those displayed on the website when you place it.

3. Products and image appearance

We take reasonable care to display images and products accurately. However, colours may appear slightly different depending on your screen settings, device and the materials used during printing.

Product dimensions and sizes are approximate unless stated otherwise.

Where prints or products are created using images selected by you, they are made to your specifications.

4. Digital images

Digital images are delivered electronically. Nothing relating to a digital-only order will be posted.

Following successful payment, you will receive access to a download link. Download links may be time-limited and may allow only a set number of downloads.

You are responsible for:

  • Providing the correct email address at checkout
  • Using a device with sufficient storage and compatible software
  • Downloading your images before the link expires
  • Saving and backing up your files after downloading them

We do not guarantee that digital files will remain available indefinitely after delivery. If your link has expired, please contact us and we will try to help, although we cannot guarantee that archived files will always remain available.

5. Licence for digital images

When you purchase a digital image, you receive a personal, non-exclusive and non-transferable licence to use it for private, non-commercial purposes.

You may:

  • Download and store the image for your own use
  • Make prints for private enjoyment
  • Share the image privately with family and friends
  • Post the image to your personal social media accounts

You may not:

  • Use the image for advertising, resale, publishing, business promotion or any other commercial purpose
  • Sell, license or distribute the digital file
  • Present the image as your own work
  • Apply filters or make substantial edits or alterations
  • Remove or obscure a watermark, signature or copyright notice

Reasonable cropping for printing or social-media sizing is permitted, provided it does not materially alter the image.

Please contact us if you would like to discuss commercial use. A separate commercial licence and fee may be required.

6. Copyright

Copyright in all photographs remains with By Sophie Photography and the photographer.

Purchasing an image, print or photography product does not transfer copyright or ownership of the original photograph. It only gives you the right to use the image as described in these terms.

The photographer’s moral rights are reserved.

7. Orders and payment

All prices are shown in pounds sterling.

By Sophie Photography is not currently registered for VAT, so VAT is not added to the prices shown.

Payment is handled securely by our payment provider. We do not receive or store your full card details.

When you place an order, you are offering to purchase the selected products. Your order is accepted when we send confirmation that it has been accepted or make the digital files available for download.

If we cannot fulfil an order, for example because of a technical problem, pricing error or unavailable product, we may cancel it and refund any amount paid.

Prices may change, but changes will not affect an order that has already been accepted.

8. Physical prints and products

Prints and other physical products will be delivered to the address provided at checkout. Please check that your delivery details are complete and accurate before placing your order.

Any estimated production or delivery period shown on the website is an estimate rather than a guaranteed delivery date, unless we have expressly agreed otherwise.

Please contact us if your order has not arrived within the estimated period.

We are not responsible for delays caused by circumstances outside our reasonable control. If a significant delay occurs, we will contact you and explain the options available.

Ownership of physical products passes to you once we have received payment in full. Responsibility for the products passes to you when they are delivered to the address you provided.

9. Cancelling digital-download orders

Consumers normally have a 14-day right to cancel an online order. However, this right can be lost when the supply of digital content begins immediately.

Before receiving immediate access to a digital download, you will be asked to:

  • Give your express consent for the digital content to be supplied immediately; and
  • Acknowledge that you will lose your 14-day cancellation right once supply begins

Once the digital content has been made available with your express consent and acknowledgement, the order cannot normally be cancelled simply because you have changed your mind.

This does not affect your rights where digital content is faulty, not as described or not supplied correctly.

10. Cancelling or returning physical products

Most photographic prints and products are made to order using images selected by you. Where a product is made to your specifications or clearly personalised, the usual 14-day right to cancel for a change of mind does not apply.

Please check your image selections, sizes, finishes, delivery address and any personalisation carefully before placing your order.

If a physical product is not personalised or made to your specifications, you may have a legal right to cancel your order within 14 days of receiving it. Please email us within that period if you wish to cancel.

Unless the product is faulty, damaged or incorrect, you are responsible for the reasonable cost of returning it. It must be returned safely and in substantially the same condition in which it was received.

We may reduce a refund if a returned product has been handled more than necessary to inspect it.

11. Faulty, damaged or incorrect products

Your statutory rights are not affected by these terms.

Digital content must be of satisfactory quality, fit for its intended purpose and as described. If a digital file is faulty, corrupt, inaccessible or materially different from its description, please contact us so that we can repair or replace it. Where that is not possible or appropriate, you may be entitled to a price reduction or refund.

Physical products must also be of satisfactory quality, fit for purpose and as described.

Please contact us as soon as reasonably possible if a product arrives damaged, faulty or incorrect. Include your order number and clear photographs of the product and packaging where possible.

Depending on the circumstances and your statutory rights, we will arrange a repair, replacement or refund.

12. Problems outside our control

We are not responsible for a failure or delay caused by events outside our reasonable control.

If such an event affects your order, we will contact you as soon as reasonably possible and take reasonable steps to minimise the effect.

Nothing in these terms excludes or restricts liability where doing so would be unlawful. This includes liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Breach of your statutory consumer rights
  • Any other liability that cannot legally be excluded

We are not responsible for business losses where products were purchased solely for personal use.

13. Personal information

We process personal information in accordance with our Privacy Policy.

14. Complaints

If something has gone wrong, please email hello@bysophiephotography.co.uk.

Please include your order number and a clear description of the problem. We will acknowledge your complaint and aim to respond within a reasonable period.

We will always try to resolve complaints fairly and directly.

15. Governing law

These terms are governed by the law of England and Wales.

If you live in England or Wales, legal proceedings may be brought in the courts of England and Wales. If you live elsewhere in the United Kingdom, you may also be entitled to bring proceedings in the courts where you live.

Nothing in this section limits any consumer protections that apply to you under the law.
